These Terms of Service (“Terms”) govern your use of TriCity Auto’s website atTricityautofinance.com(the “Site”) and your purchase or financing of used vehicles and related services from TriCity Auto (“we,” “us,” or “our”) at 109 Bridgeport Rd E, Waterloo, ON N2J 2K3. By accessing or using the Site or completing any transaction with us, you agree to these Terms in full. If you do not agree, do not use our Site or services.

1. Eligibility & Acceptance

• You are at least 18 years old and can enter binding contracts.
• All information you provide is true, complete, and accurate.
• You will comply with these Terms and all applicable laws.

2. Services & Content

• Used Vehicle Sales & Trade-Ins: Vehicles are sold “as-is” unless a written warranty is provided; trade-in values are estimates pending inspection.
• Financing: We assist with financing, but lenders determine terms and approval. Approval is not guaranteed.
• Additional Services: Warranties, insurance referrals, and accessories are offered under separate agreements.
• All content on the Site is informational. We do not guarantee accuracy or suitability.

3. User Obligations

• Do not use the Site unlawfully or fraudulently.
• Do not impersonate or misrepresent identity.
• Do not tamper with or reverse-engineer the Site.
• Do not harvest data from other users.

4. Purchase & Financing Terms

• Pricing: Prices are in CAD and exclude HST and fees. Errors may be corrected.
• Deposits: Vehicles are held only after deposit; terms are disclosed before payment.
• Credit Applications: Submission does not mean approval.
• Down Payments: Typically range from $500–$1,000+ depending on credit.
• Delivery: Title and risk transfer after full payment or funding.

5. Disclaimers & No Warranties

YOUR USE OF THE SITE AND PURCHASED VEHICLES IS ENTIRELY AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SPECIFIC VEHICLE OR SERVICE GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to indemnify and hold harmless TriCity Auto and its affiliates from any claims or expenses resulting from your breach of these Terms or unlawful use of the Site.

8. Force Majeure

We are not liable for any failure or delay due to events outside our control, including natural disasters, pandemics, internet outages, or government actions.

9. Third-Party Links & Services

The Site may contain links to third-party websites. We are not responsible for their content, policies, or terms. Use them at your own risk.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Ontario and Canada. Disputes will be resolved exclusively in the courts of Waterloo Region, Ontario. You waive any right to jury trial or class action.

11. Severability & Waiver

If any part of these Terms is deemed unenforceable, the rest remain valid. Our failure to enforce a right does not waive that right.

12. Modifications & Entire Agreement

We may update these Terms at any time. Continued use means you accept the updated Terms. These Terms and our Privacy Policy form the entire agreement between you and TriCity Auto.
